REVISED EMPLOYMENT ELIGIBILITY VERIFICATION I-9 FORM |
ATTENTION – The newly revised Employment Eligibility Verification I-9 Form goes into effect on December 26, 2007. As of this date the old I-9 Form becomes obsolete and the use of the new I-9 Form must be used.
The U.S. Citizenship and Immigration Services (USCIS) announced in the Federal Register that all employers must transition to the new I-9 Form no later than December 26, 2007. Therefore, effective December 26, 2007, employers who fail to us the Revised I-9 Form will be subjected to applicable penalties.
The revised form includes the revision date (Rev. 06/05/007) printed on the lower right corner of the form. This revised form is now the only valid version for use. All previous versions of the I-9 Form in English or Spanish will not be valid after December 26, 2007.
The revised I-9 Form is available in English and Spanish. However, only employers in Puerto Rico may have employees complete the Spanish version. Employers in the 50 states and other U. S. territories may use the Spanish version as a translation guide for Spanish-speaking employees, but the form must be completed in the English version and maintained in the employer’s records. Employees may also use or ask for a translator/preparer to assist the employee to complete the form.
The revised I-9 Form becomes effective on December 26, 2007 for all new hires or for re-verification purposes. This rule is not retroactive. Employers do not have to complete new forms for existing employees for whom an I-9 Form has been properly completed. The employer is not required to provide the social security number in Section 1 of the I-9 form unless the employer participates in the E-Verify program. When re-verifying employees, employers must use the New I-9 Form along with its updated list of acceptable documents. Employers are not allowed to update Section 3 on the old/existing I-9 Form.

Also, scroll down under Employer Information and select M-274, Handbook for Employers which gives instructions for completing the Form I-9.
